TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern your use of the Glowa Organic website and your participation as a customer and/or independent distributor. By registering an account, placing an order, or otherwise using this website, you agree to be bound by these Terms. If you do not agree, please do not use this website.
1. WHO WE ARE
Glowa Organic ("we", "us", "our") is a South African business selling skin and wellness products both directly to retail customers and through a network of independent distributors who earn commissions on sales and team-building activity. 2. ELIGIBILITY AND REGISTRATION
2.1 You must be at least 18 years old and legally capable of entering into a binding contract to register as a distributor or place an order.
2.2 You must provide accurate, current, and complete information when registering, and keep that information up to date.
2.3 Each person may hold only one distributor account. Duplicate or fraudulent accounts may be suspended or terminated.
2.4 A one-time registration fee applies to become a distributor, as shown on our Pricing page. This fee is separate from any stock package purchase.
3. DISTRIBUTOR RELATIONSHIP
3.1 As an independent distributor, you are not an employee, agent, partner, or legal representative of Glowa Organic. You operate your own independent business and are responsible for your own tax, business registration, and legal obligations arising from that activity.
3.2 Commissions are earned according to the compensation structure published on our Opportunity page, which may be updated from time to time. Updates apply to future activity and do not retroactively reduce commissions already earned and paid.
3.3 INCOME DISCLAIMER: Any income earned through this business depends on individual effort, sales ability, and the size and activity of your downline team. We do not guarantee any specific level of income, and results vary significantly between distributors. Participation should not be treated as a guaranteed source of income.
3.4 Distributors must not make false, misleading, or exaggerated income claims when recruiting or marketing to others.
4. ORDERS AND PAYMENT
4.1 All prices are displayed in South African Rand (ZAR) and are shown on our Pricing page.
4.2 We accept the payment methods shown at checkout, which may include card payments (PayFast/Yoco), EFT, or a payment link, depending on what is currently enabled.
4.3 For EFT and payment link orders, your order is only confirmed once we have verified receipt of payment. Please allow reasonable time for manual confirmation.
4.4 We reserve the right to cancel or refuse any order, including where payment cannot be verified, stock is unavailable, or we reasonably suspect fraud.
5. DELIVERY
5.1 Delivery options, timeframes, and fees are shown on our Delivery page and at checkout, and may vary based on your location and the delivery method selected.
5.2 Risk in goods passes to you on delivery to the address you provided. Please ensure your delivery details are accurate.
6. REFUNDS AND CANCELLATIONS
Refunds and cancellations are governed by our separate Refund Policy and Cancellation Policy, which form part of these Terms.
7. PROHIBITED CONDUCT
You may not: (a) use the website for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the website or other users' accounts; (c) engage in pyramid-scheme conduct prohibited under South African law, including recruiting primarily for the purpose of collecting recruitment fees rather than genuine product sales; (d) infringe our intellectual property or that of any third party; or (e) misuse the support chat, referral system, or any other feature of the platform.
8. INTELLECTUAL PROPERTY
All content on this website, including text, graphics, logos, and product images, is owned by or licensed to Glowa Organic and may not be copied, reproduced, or used without our prior written permission, except as reasonably necessary for your own marketing as an active distributor (for example, using the Marketing Kit tools provided on your dashboard).
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Glowa Organic shall not be liable for any indirect, incidental, or consequential loss arising from your use of the website or participation in the business, including loss of income or business opportunity. Nothing in these Terms limits liability that cannot lawfully be excluded under South African law, including under the Consumer Protection Act 68 of 2008.
10. ACCOUNT SUSPENSION AND TERMINATION
We may suspend or terminate your account for breach of these Terms, suspected fraud, or unlawful conduct. You may close your own account at any time by contacting us; any wallet balance owed to you at the time will be processed in line with our standard withdrawal process.
11. CHANGES TO THESE TERMS
We may update these Terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the updated Terms. Material changes will be highlighted where reasonably practicable.
12. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.
